Barnes & Noble chair wants to buy retail business

NEW YORK (AP) ? Barnes & Noble founder and Chairman Leonard Riggio has told the book seller he is going to try to buy the company's retail business.

The news sent shares up nearly 9 percent in midday trading.

Riggio disclosed in a regulatory filing Monday that he wants to acquire the company's stores and website, but not the business that makes the Nook e-reader or the company's college bookstores. No price was disclosed.

It's the latest attempt by a company founder to take back control of all or part of a company he founded. Best Buy's co-founder Richard Schulze is mulling a bid for the electronics retailer, and Michael Dell earlier this month announced a $24.4 billion deal to take the namesake computer company he founded private. The deals are a way executives can have more control over companies without the need to run everything by shareholders.

"When you've got control outside public eye or public market, you can invest and translate your strategy at your own pace," said Morningstar analyst Peter Wahlstrom.

Riggio, who founded Barnes & Noble in the 1970s and helped it expand its "big box" presence, is Barnes & Noble's largest shareholder, with nearly 30 percent of the company's shares. (While Riggio didn't found the original Barnes & Noble store in New York, which opened in 1917, he bought the store and brand name in the 1970s to create the current-day company.)

Barnes & Noble said the offer will be considered by a committee of three independent directors. But there is no set timetable for the process.

The New York-based bookseller has been struggling to find its place in the retail landscape as more readers have shifted to electronic books and competition has grown from discount stores and online competitors.

It has invested heavily in its Nook e-book readers and digital library and struck a deal with Microsoft last April to create a Nook subsidiary.

But the Nook faces tough competition from other devices like Apple's iPad Mini, Amazon's Kindle and Google's Nexus tablet.

Earlier this month, the company said it expects Nook media revenue of less than $3 billion. It also anticipates a loss for the unit before interest, taxes, depreciation and amortization to exceed the $262 million loss recorded in its 2012 fiscal year.

This follows a report from the retailer in January that its Nook unit revenue fell 12.6 percent to $311 million during the critical holiday period. Overall sales during the holiday period fell 10.9 percent at bookstores and online compared with a year ago. Barnes & Noble is scheduled to report third-quarter results Thursday.

The filing with the U.S. Securities and Exchange Commission said Riggio will seek to negotiate a price with Barnes & Noble's board and pay for the deal with cash and debt.

Riggio is making the offer in order to facilitate the company's review of its strategic options for separating its Nook business, according to the filing.

Morningstar's Wahlstrom said the deal makes sense considering the retail side of the business has been overshadowed by investments needed for the Nook business.

"The retail business for Barnes & Noble is mature-slash-declining, but it's profitable," he said. "The company has done a good job executing amid a pretty challenging environment."

Wahlstrom added that the move by Riggio was not unexpected and has been a possibility for years. His large stake in the company and history would likely make finding any extra needed financing not much of a problem, he said.

"Riggio feels like he can run it better than just about anyone else, and with four decades of operating history there's not much reason to believe that he can't," he said.

Barnes & Noble operates 689 bookstores in 50 states and 674 college bookstores.

Shares rose $1.18, or 8.8 percent, to $14.69. Its shares have traded in a 52-week range of $10.45 in mid-April to $26 later that same month.

Though likely to be confirmed, McCain questions Hagel's qualifications

Chuck Hagel is expected to be confirmed as secretary of defense by the Democratic-controled Senate. On Sunday, Republican Senator John McCain said he did not believe Hagel is qualified for the job, despite their personal friendship.?

Before going on a weeklong recess, Republican lawmakers succeeded in delaying a Senate vote on Hagel's nomination earlier this month. Hagel is expected to win confirmation if a vote is held because Democrats control 55 votes in the 100-seat?Senate.

"I do not believe that?Chuck Hagel, who is a friend of mine, is qualified to be secretary of defense," McCain of?Arizona?said on CNN's "State of the Union" show.

"I believe that when the questions are answered, and I believe they will be by this coming week that the president deserves an up or down vote" on Hagel, said McCain, who is a member of the?Senate Armed Services Committee.

Hagel's nomination was likely to go for a vote in the?Senate?"barring some additional revelation," he said.

Amid tensions in Asia, Obama hosting new Japan PM

President Barack Obama welcomes Japan's new prime minister to the White House on Friday to reinforce a core U.S. alliance at a time of high tension stoked by a Japan-China territorial dispute and a North Korean nuclear test.

Shinzo Abe is a nationalist and a keen advocate of stronger relations with Washington that have assumed more importance for Tokyo as it has locked horns in recent months with emerging power China over the control of unoccupied islands in the resource-rich seas between them.

Abe, who arrived Thursday afternoon and will leave early Saturday, has been anxious for the Oval Office meeting since he returned to power after a convincing election victory in December for his second stint as prime minister since he resigned for health reasons in 2007 after serving for one year.

The U.S. partnership with Japan, which hosts about 50,000 American forces, is an enduring one and a cornerstone of Washington's Asia policy, but establishing a personal rapport between leaders has been difficult. As Japan has struggled with its prolonged economic malaise, there's been a rotating door of prime ministers. Abe is the fifth since Obama took office.

Abe's market-pleasing moves to stimulate Japan's economy ? dubbed 'Abenomics' ? have fueled hope of a recovery and are expected to feature in a policy speech he will deliver at a Washington think tank after the meeting and working lunch with Obama at the White House.

The U.S. will be gauging Tokyo intent to join negotiations on the Trans-Pacific Partnership, a region-wide free trade pact being pushed by Washington. Abe may give pointers, but is widely expected to hold back from such a commitment that is opposed by most of his party and Japan's small but politically powerful farming lobby, at least until after key elections in July for the upper house.

Joe Hinrichs, Ford Motor Co.'s president of the Americas, said that Abe should be told to open Japan's automobile markets, as only about 4 percent of cars sold there are made by foreign auto companies.

"We hope the U.S. government will send a clear message that any future trade policy with Japan must ensure a level playing field and not come at the expense of American workers," he said Thursday.

On the security issues roiling northeast Asia, the U.S. and Japan will show solidarity in the face of North Korea's recent long-range rocket launches and last week's nuclear test, and reiterate their support for the U.N. Security Council to agree upon tougher sanctions against Pyongyang. They could also discuss military cooperation and missile defense.

More delicate will be how Obama and Abe address Japan's dispute with China over the Japanese-administered Senkaku islands that flared after Tokyo nationalized some of them in September. China also claims the tiny islands, which they call Diaoyu. It has stepped up patrols into what Japan considers its territorial waters, heightening concern that the dispute could spark a conflict between the world's second- and third-largest economies.

Tokyo accused China last month of locking weapons-guiding radar on a Japanese destroyer and a helicopter, in what it viewed as a dangerous escalation. Beijing accused Tokyo of fabricating the reports to smear China.

Abe will seek a reaffirmation of U.S. treaty obligations to help Japan in the event of conflict ? spelled out in clear terms last month by then-Secretary of State Hillary Rodham Clinton, who said the U.S. opposes any unilateral actions seeking to undermine Japan's administration of the islands.

Obama will likely give that assurance but tread cautiously. The U.S. is at odds with China on many issues ? Washington's growing concern over cyber theft is a clear example. But the U.S. wants to avoid a conflict in the region and is wary of alienating Beijing whose support is needed to pressure North Korea over its nuclear and missile programs that potentially threaten the U.S.

Danny Russel, National Security Council senior director for Asia, said Obama will find it useful to get an update on the high-level contacts between Tokyo and Beijing.

"The president's focus, as you can imagine, is on the importance of managing these issues in a diplomatic way that lowers the tensions," Russel said in a briefing to reporters ahead of Abe's visit.

"Obama will not want to contribute to the impression that already exists in China that the U.S. and Japan are ganging up against China," said Robert Hathaway, director of the Asia program at the Wilson Center think tank in Washington.

Japanese citizens' concern over China's growing assertiveness played a part in the return to power of Abe. He has increased defense spending and supports a more active role for Japan's armed forces, such as being able to come to the defense of its allies like the U.S. if they come under attack.

Abe's nationalist outlook and views about Japan's wartime past ? he has previously denied that its military forced women into sexual slavery during World War II ? have raised hackles in Asia. But perhaps mindful of the potential diplomatic fallout, Abe has skirted the issue since taking office and has taken some tentative steps to patch up strained relations with South Korea and China.

(AP) ? Record executive Clive Davis says he's bisexual.

In his new memoir, out Tuesday, the twice-divorced 80-year-old reveals that he had sex with a man in the 1970s. Davis writes in "The Soundtrack of My Life" that he hadn't been repressed or confused during his marriages and that sex with a man "provided welcome relief."

He also writes that he started dating a man from 1990 to 2004, which he says was a "tough adjustment" for his son Mitchell. He says after "one trying year," he and his son worked things out. Davis is the father of three children.

Davis is the chief creative officer of Sony Music Entertainment. He writes that he's been in a "strong monogamous relationship" with a man for the last seven years.

She is studying the health of coral reefs and marine ecosystems in Indonesia, and is helping to plan a new project, Capturing Coral Reef Ecosystem Services. This is her final post.

Our last stop is Bali. Once we were free from the crush of oppressive traffic and overt tourism in Denpasar, I did get lost in the rapture of my surroundings ? it seems like everything the Balinese touch turns beautiful. From the seductive Hindu temples of Uluwatu and roadside architecture, to the small inviting byways and richly turned fabrics, the back roads of Bali are enticing. But we were still on duty as scientists, with tasks to accomplish.

This beautiful culture is also over-loved in terms of tourism and development. My final dives were to some islands close to Denpasar with well-developed hotel-based tourism.

The dives on the reefs, in super-high currents, were on the list for our last trip a year ago, but one of the scientists on our team developed typhoid, and instead we spent the time watching over her in one of Denpasar?s excellent small clinics.

Many locations in Southeast Asia have a high incidence of typhoid. One of my areas of specialization is as a disease ecologist of marine organisms. It is a little different from being a doctor for people. However, it does mean that I am fascinated by the same viruses, bacteria and fungi that medical doctors deal with to help their human patients.

I am interested in the transmission routes these germs take in nature and the aspects of their biology that allow them to cross from one host to another. Examples of what we call zoonoses include the now-famous Kendra virus, transmitted from horse to human, or rabies, from dogs to humans. Then there are the bugs that are passed from humans to coral, in reverse zoonosis. My students and I are on the hunt for their reservoirs or hiding places in natural ecosystems, and want to know how environmental changes can affect disease risk for both humans and wildlife.

That brings me back to typhoid. It is caused by a bacterium, salmonella typhi. It is prevalent in places that do not have good septic treatment because its route of transmission is what we call fecal-oral, and I think that is all I have to say.

I am not a human doctor, so I do not have the best data on levels of typhoid transmission, but Craig Altier, a salmonella expert from the Cornell University College of Veterinary Medicine, tells me that places in Indonesia have some of the highest levels of typhoid in the world. And it made my friend very sick, very quickly, with what looked like a bad stomach flu, but included blood and heart complications.

Treatment involves large doses of antibiotics and is usually successful as long as you don?t happen to tangle with an antibiotic-resistant strain. Thankfully that didn?t happen in my colleague?s case, but there was another nasty complication. The typhoid was accompanied by another bug, called entamoeba histolytica ? also known as amoebic dysentery ? which also follows the same transmission routes. The typhoid and amoebic dysentery presented a double whammy, and without the extremely good health care she received, could easily have been fatal.

And here is why many of us are interested in a concept called ?one health?: There is excellent evidence linking human health and environmental health. One goal in our work in Indonesia is to see if we can link high levels of human infections with adverse health in the ocean environment.

I work on the infectious diseases of corals, which live in near-shore coastal locations. Coral health is a good sentinel for the well being of reefs. When conditions in the water get bad, corals get sick. And since corals can?t move and wear their entire being on their surface, they get sick in very obvious, place-based ways.

For example, the black band disease I talked about in my first post reliably increases when temperatures increase, and it also increases when there is an overabundance of nutrients.

Another well-known example is a coral disease called white pox from the Florida Keys. White pox looks like coral measles ? its symptoms include ulcerative white spots all over the coral?s surface. The white spots eventually coalesce, causing lesions that eat all the living tissue away and kill the coral.

Some cases of white pox are caused by a fecal coliform bacterium, serratia marcescens. Katie Sutherland, a scientist in Florida, was able to link the disease-causing bacterium to fecal coliform strains cultured from human sewage treatment plants.

Earlier during our trip, in Sulawesi, I showed pictures of us collecting samples to test for the presence of a group of fecal coliforms, called enterococci. They are the same ones the Environmental Protection Agency in the United States uses as an indicator for the safety of our waters.

In the United States, the notifiable limit set by the E.P.A. is 35 counts per unit (C.P.U. means the number of bacteria cultured from a standard water sample of 100 milliliters). Our preliminary samples from some coral reef locations near heavily populated islands ranged from 3 to more than 200 C.P.U. That is not a healthy condition for people swimming in the water or eating fish from that water. We also found corals in this area with higher than background levels of disease.

Human pollution is hardly the only threat to our marine life. My lab, and a group of scientists linked through a research network I run, financed by the National Science Foundation Biological Oceanography, work on how climate change is making both animals and plants sicker in the world?s oceans.

Our work has shown that several diseases of corals increase during extreme warming, which we can anticipate in the coming decades.

So how does this relate to the spectacular and somewhat dangerous dive I am about to take? Climate-driven warming alone will likely cause many opportunistic infections in corals in the coming decades. As good stewards of this most precious of marine resources, we need to do the science that shows us how to make these reefs more resilient, so that they get through this rather tight bottleneck humans are imposing.

And so on to the dive: I am now in a spectacular location in Bali, notorious for extremely strong currents (think fast-flowing rivers), some of which have the dangerous property of sweeping downward, sort of like an undersea water-fall. The same colleague who became sick with typhoid cautioned me, ?Be very careful diving there, Drew, several people have died from being swept down too deep by those strong currents during the past year.? Great.

I made sure to pick a highly reputable and competent dive company. And I asked them to not only take me to their most beautiful sites with high coral cover, but also ones that are potentially affected by poor tourism practices, like discharging untreated sewage.

I am advising an international team of coral health biologists, including Indonesian scientists, to develop comprehensive identification of the predominant coral disease syndromes throughout Indonesia. Happily, in most locations of Indonesia, we are so far finding some of the lowest levels of coral disease in the world.

In most of our sites ? for example, Wakatobi National Park or Biak, Papua ? less than 1 percent of every coral colony is sick. This can be compared to some sites in the Caribbean, like Puerto Rico or the Mexican Yucatan, where we have found over 30 percent of the remaining corals to be sick. We are very interested to find out why the levels of coral disease are so low on the species-rich reefs of Indonesia, and what kinds of ecosystem services make these corals more resilient to disease.

Still, the area is not problem-free. We have seen locally high levels like those next to the tourist operations here, where sewage is released directly onto the reef.

How do I know they are discharging sewage? As we started our drift dive near a tourist pontoon, the relatively murky water and toilet paper floating by were good indicators.

And the ulcerative white spot diseases of this area?s corals are a good indicator that all is not well.

I saw these sick corals at the beginning of this dive and hadn?t seen them at other locations. And I saw a lot of reef on this dive, since it was a heck of a fast dive in very high currents, covering well over a kilometer.

It was, as I was warned, tricky; every time I grabbed hold to snap a picture, my dive buddy would be swept out of sight with the current. I didn?t run into any down currents, but we did hit a fast up current along one wall, like an elevator, that made it hard to keep at depth.

Happily we were quickly washed from the tainted reefs to a bright, clear, lovely rich reef filled with cool stuff like big sea snakes, tiny bright blue moray eels, a high diversity of corals, a high diversity of fish and of course, clown fish.

Locations like this depict the value of our plan to team with the Nature Conservancy to develop a Pacific-wide coral health survey ? to use coral health as a sentinel for reef-wide sustainability and a fast-changing indicator of declining environmental conditions.

The good news is that local environmental stressors like sewage discharge are relatively easy to fix, compared with the larger global issue of climate change.

All in all, this was a productive trip, where I was able to juggle work on two coral reef sustainability projects. We were able to advance the Capturing Coral Reef Ecosystems Services Project, by finding sites where the value of ecosystem services of marine protected areas, coral reefs and mangroves can be advanced, and we were able to identify firsthand some key issues in supporting new eco-businesses in the coral triangle.

I was also able to move forward our work with the National Science Foundation-supported One Health project, by developing with colleagues at Hasanuddin University in Sulawesi new assays for bacteria in the water and new sites for surveying coral health.

The rich and unique center of coral biodiversity that thrives in Indonesia provides an unusual opportunity as a study system for those lucky to be welcomed as partners. At the same time, it is a global commons that is in need of help through new partnerships that the Indonesians can use to steward their resources.

Asteroid 2012 DA14's Friday Flyby: A Stargazer's Guide

Scientists and amateur observers alike are eagerly awaiting Friday's historic flyby of asteroid 2012 DA14, which will zoom inside Earth's ring of geosynchronous satellites.

At its nearest approach Friday (Feb. 15), the 150-foot-wide (45 meters) asteroid 2012 DA14 will be just 17,200 miles (27,000 kilometers) from Earth ? the closest encounter with such a large space rock that researchers have ever known about in advance.?

Astronomers will take full advantage of the flyby, tracking the?near-Earth asteroid?with a variety of instruments to learn more about it and space rocks in general. And some well-placed skywatchers may be able to follow 2012 DA12 's path across the heavens Friday as well, weather permitting.

Will you be able to see it?

As in real estate, the key to viewing the flyby is location, location, location.?

At the time of its closest approach on Friday ? 2:24 p.m. EST (1924 GMT) ? 2012 DA14 will be passing directly above the eastern Indian Ocean off the Indonesian island of Sumatra. That?s bad news if you live in the Western Hemisphere, Hawaii or New Zealand, where it will be daytime with no chance of seeing the asteroid. (But everyone can watch the flyby at SPACE.com, which will air footage from several telescopes around the world.) [Asteroid 2012 DA14;s Close Shave Explained (Infographic)]?

But 2012 DA14 will be visible from parts of Europe, Africa, Asia and most of Australia (where it will be just before sunrise on Saturday morning).

To those who manage to get it in view, the most striking aspect will be the movement of the asteroid against the background stars, as it will move at 0.8 degrees per minute. That?s nearly twice the apparent diameter of the moon!?

As seen through the eyepiece of a high-power telescope, the asteroid will appear to whiz rapidly across your field of view, somewhat reminiscent of the second hand of a clock.

Speaking of telescopes ? you'll need some kind of optical aid to spot 2012 DA14. At its brightest, the space rock will shine at a magnitude of +7.4; under a very dark, clear sky, a person with average eyesight can see stars down to magnitude +6.5. (The higher the magnitude, the dimmer the object).

So to view the asteroid, you?re going to need a good pair of binoculars, or better yet, a moderately big (6-inch or larger) telescope.

How to find it

The asteroid will be sweeping up from below the orbital plane of our planet, which is why it will be visible only to those who live in the tropics or the Southern Hemisphere.prior to about 1 p.m. EST (1800 GMT) on Friday. [See Photos of Asteroid 2012 DA14]

Thereafter, however, 2012 DA14 will vault rapidly northward from a position in the far-southern sky roughly midway between the Southern Cross and the asterism known as the "False Cross." It will race north through the middle of Hydra and across the constellation of Crater and westernmost Virgo before passing very close to the bright star Denebola, which marks the tip of the tail of Leo (the Lion) some minutes before 3:00 p.m. EST (2000 GMT).?

You will need a good star atlas and accurate positions of where the asteroid will be on a minute-by-minute basis. NASA's Jet Propulsion Laboratory (JPL) in Pasadena, Calif., provides this information, via its Horizons system.

Go to the Horizons Web interface at?http://ssd.jpl.nasa.gov/horizons.cgi. For Target Body, type in "2012 DA14;" for Observer Location, enter your latitude and longitude; and for Time Span, select an interval of one minute (because the asteroid will be moving so fast).?

For Table Settings, choose Astrometric R.A. and Dec, as well as Visual Mag. Click Use Selected Settings, and then Generate Ephemeris. Now you?ll have a precise set of positions for the asteroid, custom-made for your location that you can plot on a star map or atlas.

Unfortunately, by the time it gets dark over North America on Friday evening, the main show will be all but over. 2012 DA14 will have faded to about 12th magnitude ? about 100 times dimmer compared to its closest approach ? and it will be moving much more slowly, being positioned roughly between the Big and Little Dippers in the far-northern sky. ?

Celestial shooting gallery

On Oct. 28, 1937, German astronomer Karl Reinmuth (1892-1979) accidentally photographed the long trail of a fast-moving asteroid. Two nights later, this asteroid passed within 460,000 miles (740,000 km) of Earth. Reinmuth named it Hermes, after the Olympian god of boundaries and travelers.?

Since the vast majority of asteroids congregate in the main belt between the orbits of Mars and Jupiter, astronomers at that time felt that Hermes? very close approach was an outstanding exception.?

"Astronomers of the day were somewhat biased," notes NASA?s Paul Chodas. "They had convinced themselves that collisions were too rare to consider."

We have since learned, however, that asteroids make very close approaches to Earth with far greater frequency than once believed.? ?

In fact, our Earth is literally in a "celestial shooting gallery." In this past year alone, for instance, 50 known asteroids have passed within 1.2 million miles (1.9 million km) of Earth.? That comes out to about one per week.

And during this past year, 11 space rocks are known to have come to within less than the moon?s mean distance from Earth ? about 239,000 miles (384,000 km) ?Six of them have passed within less than half the moon?s mean distance of 119,000 miles (191,000 km) from Earth, at an average interval of about two months.

Researchers at JPL's Near-Earth Object Program Office estimate that an asteroid the size of 2012 DA14 flies this close every 40 years on average and that one will impact Earth, on average, about once every 1,200 years.

Innovative technique pinpoints protein locations, helping scientists figure out their functions

Feb. 12, 2013 ? An innovative technique which pinpoints protein locations and helps researchers unravel the protein's functions has been developed by the researchers from the Massachusetts Institute of Technology (MIT), researchers who recently moved from MIT to the Ulsan National Institute of Science (UNIST) explain.

Scientist from MIT have now developed a technique that can tag all of the proteins in a particular region of a cell, allowing them to more accurately map those proteins.

"There was no previous high-quality map of the matrix subdomain of mitochondria, and now we have one" said Alice Ting, the Ellen Swallow Richards Associate Professor of Chemistry at MIT. "We're still really far from that goal, but the overarching motivation is to get closer to that goal."

This innovative technique combines the strengths of two existing techniques -- microscopic imaging and mass spectrometry -- to map proteins in a specific cell location and generate a comprehensive list of all the proteins in that area.

In a paper appearing in the Jan. 31 online edition of Science, Rhee and colleagues used the new technique to identify nearly 500 proteins located in the mitochondrial matrix -- the innermost compartment found in mitochondria, which can be thought of as the power houses of the cell where energy is generated. Previous attempts to map the entire set of proteins in the matrix (proteome) yielded a list of only 37 proteins.

Protein labeling

To demonstrate the technique's power, the researchers created a comprehensive list of the proteins found in the mitochondrial matrix. Most of a cell's energy generation takes place in mitochondria, as well as many biosynthetic processes.

Using the new method, the team increased the number of proteins known to be located in the mitochondrial matrix. "There was no previous high-quality map of the matrix subdomain of mitochondria, and now we have one," says Ting, adding that this new wealth of information should help biologists to learn more about the functions of many of those proteins.

Already, the team has found that an enzyme called ppox -- involved in synthesizing heme, the iron-porphyrin complex found in hemoglobin -- is not located where biologists had thought it was. As heme precursors move through the biosynthetic pathway, they are shuttled to different parts of the cell. Finding that ppox is in the matrix means that there must be unknown transporter proteins bringing heme precursors into the matrix, Ting says.

The researchers are now investigating proteins found in another compartment of the mitochondria, the intermembrane space. They are also modifying the chemistry of the labeling system so they can use it for other tasks such as mapping the topology of membrane proteins and detecting specific protein-protein interactions.

The lead scientists of this research are Hyun-Woo Rhee (former MIT postdoc, currently Assistant Professor, School of Nano-Bioscience and Chemical Engineering, UNIST) and Peng Zou, who received a PhD from MIT in 2012.

Police said someone stole the four heat pumps from Gloria Dei Lutheran Church in Arnold about two weeks ago by cutting the wires and piping from the back of the building, loading them into a truck and driving off.

Apple CEO Tim Cook is calling a shareholder lawsuit against the company a "silly sideshow," even as he said he is open to looking at the shareholder's proposals for sharing more cash with investors.

Investor David Einhorn sued Apple Inc. last week, saying a proposal slated for a vote at the company's annual meeting in two weeks would make it more difficult to enact his plan to reward shareholders by distributing a new class of shares.

Cook said Apple's proposal puts more power in the hands of shareholders, making it difficult to understand why a shareholder would fight it. Calling the fight a waste of time, Cook said Apple won't waste money by mailing shareholders to persuade them to vote for the proposal.

"My preference is that everyone on both sides of this issue would take the money they're spending on this and donating it to a worthy cause," Cook said.

Repeating previous statements, Cook also said that the company is "seriously" looking at ways to hand out more cash to shareholders.

Investors appeared to be listening for something more substantive out of Cook on the cash issue. Apple's stock fell $7.40, or 1.5 percent, to $472.53 in afternoon trading after his morning speech at a Goldman Sachs investor conference in San Francisco.

The stock market has hammered Apple's stock since the September launch of the iPhone 5. The company's growth, which has been rapid for nearly a decade, is slowing drastically in the absence of a new groundbreaking product. Wall Street is clamoring for Apple to share more of its cash, which amounted to $137 billion at the end of last year and is still growing fast because of the company's massive profits.

Companies normally don't sit on that much cash, as it's not very productive. They prefer to invest it in their business or give it to shareholders. Einhorn said Apple's cash hoard is a symptom of a defensive, "Depression-era mentality."

Cook rebuted that assertion Tuesday, saying the company invested $10 billion in its business last year, through spending on research and design, equipment and an expansion of its chain of stores. It has also committed to handing out $45 billion to shareholders over three years, through dividends and share buybacks.

Analysts, however, point out that Apple seems to have run out of things to invest in, and the $45 billion commitment is small compared with the company's profits.

Goldman analyst Bill Shope asked Cook about two other hot-button issues: whether Apple would make a cheaper phone and one with a larger screen, both of which rivals have been doing using Google's Android operating system. Cook was as usual evasive about Apple's product plans, preferring to point out that it sells older iPhone models at a reduced price and that there's more to the experience of a screen than its size.

Military officials say they believe the problems can be overcome and are moving forward with plans. But proposed fixes could be difficult. One possibility has already been ruled out as technically unfeasible. Another, relocating?missile?interceptors planned for Poland and possibly Romania to ships on the North Sea, could be diplomatically explosive.

The studies are the latest to highlight serious problems for a plan that has been criticized on several fronts. Republicans claim it was hastily drawn up in an attempt to appease Russia, which had opposed an earlier system. But Russia is also critical of the plan, which it believes is really intended to counter its?missiles. A series of governmental and scientific reports has cast doubt on whether it would ever work as planned.

At a time that the military faces giant budget cuts, the studies could prompt Congress to reconsider whether it is worthwhile to spend billions for a system that may not fulfill its original goals.

The classified studies were summarized in a briefing for lawmakers by the Government Accountability Office, Congress' nonpartisan investigative and auditing arm, which is preparing a report. The GAO briefing, which was not classified, was obtained by The Associated Press.

Military officials declined repeated requests to discuss the studies on the record, noting they were classified. Even speaking on condition of anonymity, they declined to say whether the GAO had accurately reported its conclusions. But the GAO briefing had been reviewed by several Defense Department officials and the revisions they requested were incorporated. There was no indication they had objected to how the studies had been described.

The officials who spoke to the AP emphasized that the interceptor intended to protect the United States is in the early stages of development and its capabilities are not known. They said that the U.S. is already protected by other?missile?defense systems. Even if European-based interceptors are unable to directly defend the United States, they say they would protect not only European allies and U.S. troops stationed on the continent, but also U.S. radars there that are necessary for all U.S.?missiledefense plans.

Missile?defense has been a contentious issue since President George W. Bush sought to base long-range interceptors in central Europe to stop?missiles?from Iran. Some Democrats criticized the plans, saying they were rushed and based on unproven technology. Russia believed the program was aimed at countering its?missiles?and undermining its nuclear deterrent.

Bird Hitches Ride On Unsuspecting Car (VIDEO)

Who knew pigeons could be so lazy?

Youtube user "lilkobe4," who was on his way home from work at the time, recently captured footage of a bird hitching a ride on the hood of his car.

The pigeon hangs on for a surprisingly long time -- at least longer than this car-surfing bird -- and even makes it to the highway.

"He was probably laughing at me the whole time," the user writes.

Yeah, dude. He probably was.

WEDNESDAY: 'Survivor'

This is the "Fans vs. Favorites" season, with 10 returning players taking on 10 new faces -- one of whom is such a fan that she named her son "Colby" after season two runner-up Colby Donaldson. Among the more entertaining returnees: Malcolm Freberg, John Cochran and Erik Reichenbach. THURSDAY: 'A Good Day to Die Hard'
Sure, you could spend Valentine's Day at a fancy fondue restaurant feeding each other bread and cheese, or snuggled up at home watching "The Notebook." But come on, people! "A Good Day to Die Hard," aka "Die Hard 5," is opening on Valentine's Day -- even though it's a Thursday and not your typical movie-opening Friday. It's like a sign from the love gods. Take your date and see Bruce Willis' John McClane character team up with his adult son (Jai Courtney) as they smash up the streets of Russia as only they can. Yippee-ki-yay, Mother Cupid! SUNDAY: 'The Amazing Race'
Yes, "Survivor's" not the only competition reality show rolling out a new season this week. "The Amazing Race" will also hit the road with 11 new two-person teams. Navy pulling ship from Persian Gulf over budget worries

Published 6:30 p.m. ET: Budget constraints?are prompting?the U.S. Navy to cut back the number of aircraft carriers in the Persian Gulf region from two to one, the latest example of how contentious fiscal battles in Washington are impacting the U.S. military.

According to Defense Department officials, the USS Harry S. Truman, which was set to leave for the Persian Gulf region on Friday, will now remain stateside, based in Norfolk, Virginia.?

Defense Secretary Leon Panetta ordered the change to the department?s ?two-carrier policy? in the Persian Gulf region early Wednesday.

The U.S. has steadily kept two aircraft carriers in the Persian Gulf for much of the last two years. In 2010, then-Secretary of Defense Robert Gates issued a directive to keep two in the area given the volatility of the region.

The cutback is largely a result of automatic spending cuts, known as sequestration, passed by Congress during the summer of 2011. Congress has failed to pass a budget for the fiscal year, and has instead opted on passing legislation that will keep spending at the same level as last year. But that means the Pentagon has been operating with less money and is unsure of what the future holds for its bottom line.

Under sequestration, the Navy would lose $4 billion over the next six months, the last half of fiscal year 2013. The Navy was already $4.6 billion in the hole for this year because the continuing resolution for 2013 was budgeted at 2012 rates.

Secretary of Defense Leon Panetta tells NBC's Chuck Todd if a sequester is allowed to happen it will "badly damage" the readiness of the U.S. military.

Navy officials say the Defense Department ordered members of their branch and all services to ?prepare for sequestration,? even though it?s not yet clear the automatic budgets cuts will kick in next month.?

?We cut back to one carrier in the Gulf region to save money now, or wait until sequestration and be forced to cut back to zero carriers,? a senior defense official told NBC News.

It?s not certain whether the Defense Department or the White House would permit a zero carrier presence in the Persian Gulf, no matter what the budget constraints, given rising tensions over Iran. The Truman would still conduct exercises off the US East Coast and would be ?surge ready? in the event of an emergency or disaster.

A statement from Pentagon Press Secretary George Little assured that the United States will ?maintain a robust presence? in the area, but cited the pending sequestration cuts as the reason the Navy sent Panetta the request.

?This prudent decision enables the U.S. Navy to maintain these ships to deploy on short notice in the event they are needed to respond to national security contingencies,? read the statement.

Revelation of the cutbacks comes the same day as news that Panetta is recommending military pay increases be limited to one percent in 2014. Uniformed military will still get a raise, but it will be much smaller ?to reflect the difficult budget decisions? facing the department, a defense official told NBC News.

At a speech Wednesday, the outgoing secretary of defense warned that the budget battles in Washington are putting America at risk. ?

?The Department of Defense and other agencies across government have been living under a serious shadow -- the shadow of sequestration ... Today, with another trigger for sequestration approaching on March 1st, the Department of Defense is facing the most serious readiness crisis in over a decade,? he said to a crowd at Georgetown University.

?Make no mistake, if these cuts happen there will be a serious disruption in defense programs and a sharp decline in military readiness,? Panetta said in his speech Wednesday.

?We have begun an all-out effort to plan for how to operate under such a scenario, but it is already clear that no good options exist.?

On Tuesday, President Obama called on Congress to pass ?a small package of spending cuts and tax reforms? to avoid the automated cuts set to kick in at the beginning of next month.

Republican Sens. John McCain and Kelly Ayotte ? who have toured the country warning that sequestration cuts could put U.S. national defense at risk ? responded on Wednesday by introducing a bill that would avoid cuts by slashing the federal workforce by 10 percent.?

Time Warner 4Q earnings up, raises dividend 11 pct

(AP) ? Time Warner Inc. said Wednesday that net income grew 51 percent in the last three months of 2012 even as revenue was largely unchanged. Rising fees from cable and satellite companies and higher ad revenue at the TV networks offset revenue declines at the movie studio and magazine businesses.

The television business drove the quarter's performance as revenue there grew 5 percent, offsetting declines elsewhere. The Warner Bros. studio business had a weaker release lineup in the most recent quarter, though it managed to report an operating profit with expense reductions. The Time Inc. magazine business, the smallest of the three, has announced layoffs to reflect reduced demand for print editions.

Time Warner said net income was $1.17 billion, or $1.21 a share, for the fourth quarter, up from $773 million, or 76 cents a share, a year earlier.

Adjusted for one-time items, earnings came to $1.17 per share. That beat the $1.10 per share that analysts surveyed by FactSet expected.

Revenue edged down to $8.16 billion from $8.19 billion a year ago. Analysts expected revenue of $8.22 billion.

Time Warner also said Wednesday that it is raising its quarterly dividend by 11 percent to 28.75 cents per share. It's payable March 15 to shareholders of record as of Feb. 28. It also said the company's board has authorized $4 billion in stock buybacks, which tend to increase the stock price for remaining shareholders. The new authorization replaces prior buyback plans, which resulted in $3.5 billion in buybacks from Jan. 1, 2012, to Feb. 1, 2013.

Time Warner's stock increased $1.42, or 2.8 percent, to $51.38 in premarket trading about a quarter-hour ahead of the market opening.

Time Warner is estimating $60 million in charges this year related to an announced layoff of about 500 employees at the magazine business, or about 6 percent of the division's global staff of 8,000. The company has been trying to cut costs to reflect decreases in revenue and the need to invest in more ways to deliver content on multiple platforms and devices.

In the fourth quarter, revenue at Time Warner's TV business grew 5 percent to $3.7 billion.

That business has gotten stronger in recent years as U.S. cable and satellite operators have been paying more to carry channels such as TNT, TBS and CNN on their lineups. The company also had more U.S. subscribers for the HBO premium channels and saw growth internationally across the TV business, despite unfavorable currency-exchange rates. Revenue from those distributor and subscription fees rose 7 percent.

Ad revenue at the networks increased 3 percent because of better rates, more NBA games shown on Time Warner channels and increased viewership at CNN during the presidential election season. Licensing and other content revenue fell 9 percent mostly because of a shutdown of TNT operations in Turkey.

At the Warner Bros. studio business, revenue fell 4 percent to $3.7 billion, largely because of a weaker lineup. The same quarter in 2011 had revenue from the home release of the final Harry Potter movie and the video game "Batman: Arkham City." Theatrical releases of the first "Hobbit" movie and "Argo" in most recent quarter weren't enough to offset those declines. But operating income increased 29 percent to $552 million partly because of lower marketing and other expenses from the timing of movie releases.

The Time Inc. magazine business saw revenue fall 7 percent to $967 million as ad revenue fell and the company no longer had money from a school fundraising business sold in early 2012. Subscription revenue was flat.

The company expects 2013 adjusted earnings to be up in the low double-digit percentage, an estimate that reflects the anticipated restructuring charges at Time Inc. It was $3.28 per share in 2013, meaning the projected range is $3.61 to $3.77. Analysts had expected earnings of $3.66 per share for 2013.
